Member Expulsion Policy


A Member Expulsion Policy will ensure a fair and appropriate process is followed with regard to member expulsion. It protects the rights of members and will ensure a safe and secure workplace and business environment for Star One management, staff, volunteers, and the membership.

This policy is not enacted to restrict the rights of the membership, but rather to address certain unacceptable conduct and protect the Credit Union's members, employees, volunteers, and property.

Star One will adhere to the requirements of California Financial Code Sec. 14456, California Corporations Code 7341, and Star One's Bylaws Article III, Sec. 306 with regard to member conduct and expulsion.


Star One's Board of Directors designates the Operations Committee the authority to determine whether to expel a member from Star One for any reason allowed by law and Star One's Bylaws. Star One may expel a Credit Union member pursuant to Star One's Bylaws Article III, Section 306 and this Policy for any of the following reasons:

  1. Conviction of a criminal offense involving moral turpitude.
  2. Failure to carry out contracts, agreements, or obligations, with Star One.
  3. Refusal to comply with the provisions of the California Credit Union Law or Star One bylaws.
  4. Abusive, threatening, or harassing behavior toward Star One staff, volunteers, or members, or the abuse of credit union systems or property.

Notification of Member Expulsion

Upon the Operations Committee's determination to expel a member, the Committee will notify the expelled member, in writing, and will provide such member with the opportunity to appeal the expulsion determination.

The Credit Union's expulsion notice will be provided under the following time periods:

  • For an expulsion determination of a member, based upon reasons 1, 2, and 3, Star One will provide the member written notice fifteen (15) business days prior to the effective date of the expulsion. The notice will indicate the member has the opportunity to be heard, either orally or in writing, by the Operations Committee as to why they should not be expelled, no less than five (5) days before the effective date of the expulsion.
  • An expulsion determination of a member, based upon reason 4, may be made immediately without any advance notice or an opportunity to be heard. Star One will provide the member written notice within five (5) business days after the expulsion.

Member Right to Appeal

Upon request of the expelled member, Star One will allow a person an opportunity to appeal the member expulsion. An expelled member, wishing to appeal an expulsion determination, must notify the Operations Committee, in writing, of the reasons for appeal within thirty (30) days after the date of expulsion. The actual appeal may take place either in person or through a written testimonial (expulsion for abusive, threatening, or harassing behavior may only be appealed in writing) and will be considered at a meeting of the Operations Committee. Decisions made at this meeting will be final and will be recorded in Star One's records and a written notice of determination will be provided to the expelled member within five (5) business days of the appeal determination.

Notification to Member of Expulsion Policy

Star One will notify all members of the Member Expulsion Policy by posting the Policy in branches as well as provide a copy of the Policy to members upon request.
